NextTier Terms & Conditions
These Terms govern access to and use of the NextTier platform and apply to users who browse the website, create an account, place orders, offer services or virtual goods, or otherwise interact through the platform.

Please read these Terms and Conditions carefully before using the NextTier platform (the “Platform” or “Website”). By registering, accessing, or using the Platform, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, Cookie Policy, and any other documents incorporated by reference. If you do not agree, you must not use the Platform.
1. Platform nature and role
- NextTier operates an online platform that enables buyers and independent sellers to interact, place orders, communicate, and resolve disputes in relation to gaming-related digital services and certain virtual in-game goods.
- NextTier acts solely as a platform operator and intermediary in relation to transactions between users.
- Unless expressly stated otherwise for a specific feature, NextTier does not own, sell, resell, or directly provide the underlying seller services or virtual goods listed on the Platform.
- The underlying transaction for a seller service or virtual good is concluded between the buyer and the relevant seller, and not between the buyer and NextTier.
- NextTier may provide Platform Services including website hosting, listing display, communication tools, payment facilitation, escrow handling, support, dispute administration, fraud prevention, and compliance-related checks.
2. Definitions
- User – Any person who accesses or uses the Platform.
- Buyer – A User who places an order for seller services or virtual goods.
- Seller – A User authorized on NextTier to offer seller services or virtual goods through the Platform.
- Seller Services – Gaming-related digital services offered by a seller to a buyer, including boosting, coaching, carry runs, challenge assistance, piloted gameplay support, or similar services.
- Goods – Permitted virtual in-game goods or other non-physical digital game-related items offered by a seller through the Platform.
- Platform Services – Services displayed on NextTier page, including platform access, order interface, payment facilitation, escrow handling, support, and dispute administration.
- Offer – A seller’s listing or proposal describing the service or goods, price, and material order terms.
- Order – A buyer’s accepted purchase request submitted through the Platform in relation to an Offer.
- Deal – The underlying transaction between buyer and seller formed through the Platform.
- Escrow – The temporary holding logic applied by the Platform to funds pending release, refund handling, dispute review, or other permitted outcome.
3. Account registration and verification
- Users must provide accurate, current, and complete information when creating or maintaining an account.
- Users must be at least 18 years old, or otherwise legally permitted to use the Platform under applicable law.
- NextTier may request identity verification, residency information, payment verification, or other compliance information from any user where reasonably necessary.
- NextTier may refuse, suspend, or terminate access where verification is not completed or where fraud, abuse, sanctions risk, or other compliance concerns exist.
4. Seller status
- Seller is authorized status to place offers and complete it following NextTier’s platform rules and may be subject to screening, identity verification, payout verification, competence review, service-category restrictions, or other onboarding rules.
- Sellers must ensure that their offers are accurate, lawful, not misleading, and capable of fulfillment.
- Sellers are solely responsible for the underlying seller services and goods they offer, including fulfillment, legality, communications relevant to delivery, and any losses arising from their breach of the deal or applicable law.
- NextTier may suspend, restrict, or revoke seller status at any time where the seller breaches these Terms, creates platform risk, or fails verification or compliance checks.
5. Buyer obligations
- Buyers must review the selected offer carefully before placing an order.
- Buyers must provide accurate order-related information and respond where scheduling or confirmation is required.
- Buyers must not misuse the Platform, abuse payment systems, harass other users, or engage in fraud, blackmail, extortion, or other prohibited conduct.
6. Relationship between the parties
- NextTier is not a party to the underlying performance of seller services or the underlying supply of seller goods, except to the limited extent required by mandatory law or explicitly stated for a specific platform feature.
- Sellers and buyers are each responsible for their own compliance with applicable law in connection with the Deal.
- Nothing in these Terms creates an employment, partnership, or joint venture relationship between NextTier and any seller unless a separate written agreement expressly states otherwise.
7. Order process
- Placement: The buyer places an order through the Platform based on an Offer.
- Processing: The order may proceed through internal statuses such as pending, accepted, in progress, completed, disputed, refunded, or cancelled.
- Administration: Status markers are administrative and do not by themselves determine legal rights if the underlying facts differ.
8. Payments, escrow, and payouts
- Payments are processed through third-party payment providers supported by the Platform.
- NextTier may place funds into escrow and delay release pending completion, confirmation, dispute review, fraud checks, chargeback risk review, or compliance requirements.
- NextTier may deduct platform commissions, payment-processing costs, chargeback-related losses, penalties, or other disclosed amounts before payout where permitted under these Terms or other applicable agreements.
- Payouts to sellers may be delayed, withheld, reversed, or offset where reasonably necessary to investigate fraud, handle a complaint, satisfy a refund outcome, or comply with law or payment-provider requirements.
9. Taxes and fees
- Sellers are solely responsible for determining, reporting, invoicing, remitting, and otherwise complying with any taxes, duties, levies, or similar obligations that may arise from their offers, deals, payouts, or other activity through the Platform, to the extent applicable under their own law and circumstances.
- Buyers are solely responsible for any taxes, duties, reporting obligations, or similar charges applicable to them under their own law and circumstances.
- NextTier’s commissions and fees are charged as consideration for Platform Services only.
- Except where mandatory law requires otherwise, NextTier does not undertake responsibility for calculating, collecting, remitting, or filing taxes owed by sellers or buyers in relation to the underlying Deal between them.
- NextTier may, where reasonably necessary or legally required, request information relevant to tax, payout, identity, or residency status and may provide transaction records or legally required information to users, payment providers, or authorities.
- Where applicable laws, tax rules, or regulatory requirements require a seller to provide a buyer with receipts, invoices, fiscal documents, or other legally required documentation relating to the underlying Deal, the seller is solely responsible for issuing and ensuring the accuracy of such documentation and for delivering it within the required timeframes. The platform may facilitate the storage, display, or transmission of such documentation on behalf of the seller, but does not prepare, issue, verify, or guarantee such documentation and shall not be responsible for its accuracy or compliance.
- Sellers shall indemnify and hold harmless NextTier from direct losses, penalties, interest, payment-provider costs, or governmental claims arising from the seller’s failure to comply with their own tax, invoicing, or reporting obligations.
10. Non-circumvention
- All material communications relating to active or potential orders must occur through the Platform channels designated by NextTier.
- Users must not attempt to bypass the Platform to complete, repeat, or continue deals outside the Platform or suggested communication channels.
- Users must not exchange direct payment details or otherwise circumvent the Platform’s payment flow.
- Breach of this section may result in account suspension, permanent removal, withholding of payouts, cancellation of platform privileges, or other enforcement measures.
11. Disputes and platform review
- Users should first attempt to resolve issues through platform support where possible.
- If that is unsuccessful, NextTier may conduct a dispute review based on available evidence.
- NextTier’s dispute function is administrative and evidence-based. It is not a court, not formal arbitration under national arbitration law unless expressly stated otherwise, and not a guarantee of any particular outcome.
- After review, NextTier may administer any procedural outcome available under the platform rules, including release, partial release, refund handling, or account measures.
12. Refund handling
Refund-related outcomes are governed by the Refund Policy. Nothing in the Refund Policy shall be interpreted as an admission that NextTier is the direct provider of the underlying seller service or goods.
13. Prohibited conduct
- Users must not engage in fraud, abusive chargebacks, seller impersonation, false evidence submission, harassment, threats, unlawful conduct, sanctions evasion, account theft, or use of bots, cheats, or exploits where prohibited.
- NextTier may investigate and act on suspected violations at its discretion.
14. Limitation of liability
- The Platform is provided on an “as is” and “as available” basis to the maximum extent permitted by law.
- NextTier does not guarantee uninterrupted availability, error-free operation, or that any seller will perform exactly as expected.
- To the maximum extent permitted by law, NextTier shall not be liable for indirect, incidental, special, consequential, or punitive damages.
- To the maximum extent permitted by law, NextTier’s aggregate liability shall not exceed the total amount of Platform Service fees retained by NextTier in relation to the dispute-causing order, or, if higher and required by mandatory law, the minimum liability that cannot legally be excluded.
15. Amendments
NextTier may update these Terms from time to time. Continued use of the Platform after an update takes effect constitutes acceptance of the updated Terms, unless mandatory law requires a different mechanism.
16. Governing law
These Terms are governed by the law of the jurisdiction in which NextTier is registered, unless mandatory consumer-protection or other mandatory rules require otherwise.
