Nexttier Terms and Conditions

Please read these Terms and Conditions (the “Agreement”) carefully before using the Nexttier platform (the “Platform” or “Website”). By registering and using our services, you agree to be bound by this Agreement, our Privacy Policy, Refund Policy, Cookie Policy, and any other documents incorporated by reference. If you do not agree with any provision of this Agreement, you must not register or use our services.
1. General Overview
This Agreement governs the relationship between you (the "User"), acting as a Buyer or Seller, and Nexttier. The Platform serves as an intermediary and guarantor for transactions between Users by providing tools and services for conducting deals. Nexttier acts strictly as an intermediary, facilitating transactions, secure payments, hosting the platform, and assisting in dispute resolution. Nexttier does not own, sell, or resell any Seller Services or Goods listed on the Platform.
2. Definitions
- User – Any individual who accesses, registers, or uses services, content, or functionality on the Platform.
- Buyer – A User who purchases Seller Services or Goods.
- Seller – A User authorized to post offers and sell Seller Services or Goods, subject to verification (including identity verification).
- Account – A registered personal account enabling Users to manage transactions and communicate securely.
- Gaming Account – An external gaming account used by Users; Nexttier is not responsible for its security or management.
- Seller Services – Digital services offered by a Seller to a Buyer, such as in-game boosting or coaching.
- Goods – Virtual in-game items available for purchase.
- Services – All services provided by Nexttier, including hosting, payment facilitation, and dispute resolution.
- Offer – A Seller’s proposal with details, pricing, and delivery terms.
- Order – A Buyer’s request to purchase based on an Offer.
- Deal – A legally binding transaction between a Buyer and Seller concluded on the Platform.
- Dispute Resolution – Procedures for resolving conflicts between Users.
3. Account Registration and Verification
- To use the Platform, you must register an account with accurate, current, and complete information.
- You must be at least 18 years old, or have verified parental/guardian consent if under 18.
- We may require identity verification (KYC) before granting Seller status or processing significant transactions.
- You are responsible for securing your login credentials and notifying us of any unauthorized access.
- Multiple accounts (“multi-accounting”) are prohibited without prior approval.
4. Relationship Between Parties
- Nexttier is a neutral intermediary. All deals are directly between Buyers and Sellers.
- Sellers must ensure offers are accurate, lawful, and fulfill delivery terms.
- Buyers must verify details before purchase and comply with applicable laws.
- Fraud, circumvention of the Platform’s payment system, or prohibited conduct will result in sanctions, including possible account suspension.
5. Deal Process
- Placed: Buyer places an Order; Seller accepts or declines.
- In Progress: Seller delivers according to agreed terms.
- Confirmation: Buyer confirms receipt, or disputes if necessary.
- Completed: Funds released to Seller; applicable bonuses applied.
Orders can be canceled under the conditions described in our Refund Policy.
6. Payments and Escrow
- Funds are held in escrow until deal completion.
- We use certified payment providers and never store sensitive authentication data (e.g., CVV).
- Withdrawals may be subject to processing times and fees.
7. Taxes and Fees
Sellers are solely responsible for their own tax obligations. Nexttier may deduct applicable commissions and processing fees as disclosed on the Platform.
8. Non-Circumvention
All communications and payments must occur through the Platform. Direct transactions outside the Platform are prohibited and may result in permanent account suspension.
9. Dispute Resolution
Users should first attempt to resolve disputes directly. If unresolved, Nexttier’s dispute resolution team will review evidence and make a decision. This process is intended to be fair but is not a legal judgment; Users retain the right to seek remedies through legal channels.
10. Sanctions
Violations of this Agreement may result in warnings, temporary suspension, permanent account closure, or financial penalties.
11. Data Protection
Personal Data is processed in accordance with our Privacy Policy and GDPR requirements.
12. Limitation of Liability
- We provide the Platform “as is” without guarantees of uninterrupted or error-free operation.
- We are not liable for any losses resulting from transactions between Users.
- Our maximum liability is limited to the total commission you have paid to us in the six months preceding the event giving rise to the claim.
13. Intellectual Property
All Platform content and software are owned by Nexttier or its licensors. Users may not copy, distribute, or modify Platform content without permission.
14. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, war, pandemics, technical failures).
15. Amendments
We may update this Agreement from time to time. Continued use of the Platform after changes take effect constitutes acceptance.
16. Governing Law
This Agreement is governed by the laws of the jurisdiction in which Nexttier is legally registered.
